Work in Progress

 GTE Sylvania and Interbrand Competition as the Primary Concern of Antitrust Law” (joint with John T. Scott)

Abstract: Footnote 19 of the landmark U.S. antitrust decision in Continental T.V. v. GTE Sylvania, Inc. 433 U.S. 36 (1977) declares that “Interbrand competition … is the primary concern of antitrust law.”  We trace the antecedents and influence of this declaration, argue that it is inappropriate, and suggest that it should be abandoned.

“Dispersion of Power as an Economic Goal of Antitrust Policy”

Abstract: I survey the range of objectives ascribed to U.S. antitrust policy during its first 60 years.  I then discuss and reject Robert Bork's analysis of the legislative intent behind the Sherman Act, and consider the Kaldor-Hicks potential Pareto improvement principle, a central element of Bork's argument that the only admissible goal for antitrust policy is the maximization of net social welfare. An elementary model shows that social preferences about aspects of market performance not captured by consumer surplus or net social welfare can be included in standard economic models.  I further argue that the role of economics as a science in analyzing market performance is limited to characterizing the costs and benefits of pursuing alternative policy objectives, and that economics as a science is agnostic concerning what policy goals should be.

“Kaldor-Hicks and All That: A Modelling Approach”

A model illuminates the importance of the assumption that the marginal utility of all other goods is constant for the Kaldor-Hicks potential compensation approach to the partial-equilibrium assessment of welfare changes and market performance.


“State Aid in Indiana”

I analyze an own-constructed database that documents financial aid granted by the State of Indiana to business.  The project documents the types of firms that received aid and analyzes the impact of aid on competition and market performance.

“International cartels: incidence and recidivism”

Connor (2016) documents the most complete dataset concerning international cartels that have been subject to antitrust prosecution for the period 1990-2013. I analyze the incidence of such cartels by industry and firm, and relate the recidivism to industry characteristics.
